Cancellation policy, waiver and release for MindXR conference:

The registration fee is refundable (less €70,- administrative fee and approx. 5% payment fee) before May 15th 2025. The conference incurs significant non-refundable expenses before the conference and therefore no refunds will be made after May 15th 2025. However, if a registrant is unable to attend, their registration can be transferred to a substitute attendee at no expense. Also please note that given recent world events (pandemics, volcanoes, tsunamis, earthquakes, etc.), no refunds will be given if any problems that are not under the organizers’ control prevent you from attending.

We strongly advise you to purchase trip cancellation insurance that covers all of your concerns if you have any.

Also, if you are delayed, please contact airlines, shuttle services and hotels directly in accordance with their cancellation policies.

In exchange for the participation in the MindXR 2025 Conference (hereafter “Conference”), hosted by XRBB e.V., including representatives from its chartered chapters, and by the scientific team (Thomas Wolbers, Marios Avraamides, Stéphane Bouchard, Sylvia Xueni Pan, Stefan Gutwinski, Anne Beck, Ruojing Zhou) the registrant agrees to be bound by each of the following:

Voluntary Participation: The participation in this Conference is voluntary.

Identification of Risks: I understand that XRBB e.V. and MindXR representatives may not at all times be present during my participation in the Conference. The participation in the Conference may involve risk of injury and loss, both to person and property. This Waiver and Release of Liability is intended to address all of the risks of any kind associated with the participation in any aspect of the Conference or with the time the registrant is involved in the Conference, including particularly such risks created by actions, inactions, or negligence on part of w²conferences or its directors, officers, employees, agents, volunteers, successors, or assigns.

Assumption of Risk: TO THE FULLEST EXTENT ALLOWED BY LAW, ALL RISKS, known and unknown, foreseeable and unforeseeable, in any way connected with the participation in the Conference. The registrant accepts personal responsibility for any liability, injury, loss, or damage in any way arising out of and connected with my participation in the Conference. The registrant AGREES TO RELEASE FROM ANY LEGAL LIABILITY AND AGREE NEVER TO SUE XRBB e.V. for any liability, injury, loss, or damage in any way arising out of and connected with the participation in the Conference, regardless of the cause, including the alleged NEGLIGENCE of XRBB e.V..

Release and Waiver: The registrant agrees to defend, indemnify and hold harmless XRBB e.V. from and against all claims, actions, causes of action, or liabilities, including reasonable attorney’s fees, costs, or judgments arising out of or resulting from the participation in the Conference.

Severability: If any term or provision of waiver or the application thereof to any person or circumstance shall to any extent or for any reason be invalid or unenforceable, the remainder portion(s) of this waiver and its application shall not be affected hereby, and each term and provision of this waiver shall be valid and enforced to the fullest extent permitted by law. Promotional Release: The Conference participant, hereby irrevocably consents and authorizes XRBB e.V. to use the image of hie/her appearance that XRBB e.V. takes during Conference in promotional material including but not limited to videos, films, photographs, and/or other related purposes without any fee whatsoever. The participant further acknowledges that XRBB e.V. is the owner of all rights to promotional material as it relates to my image and Conference.

Binding Effect: this instrument shall be binding upon participant’s registration for Conference. Applicable Law: this waiver shall be governed, construed and enforced in accordance with the law of Berlin-Brandenburg | Germany.

Cell Phone Usage: The Conference Participant, allows for XRBB e.V. and its representives to obtain the phone number and send information, including but not limited through, SMS text message as related to XRBB e.V. and its representives and Conference purposes.

General Terms and Conditions

§ 1 Scope of Application

  1. These Terms and Conditions apply to the use of the online portal https://extendedrealitybb.org.
  2. Deviating, conflicting, or supplementary terms and conditions of the user or modifications of these conditions shall not apply.
  3. For certain special services offered by Extended Reality Berlin-Brandenburg e.V., such as the Extended Reality Berlin-Brandenburg e.V. Club, directory listings, and advertising banner marketing, in addition to these Terms and Conditions, Special Terms apply. In case of any discrepancies, the Special Terms will take precedence over these Terms and Conditions.
  4. Some of the services available through https://extendedrealitybb.org are provided by or in cooperation with third parties. In such cases, the terms and conditions of these third parties/partners may apply. Users will be notified separately about this. Contracts with commercial providers or other third parties introduced or facilitated through the Extended Reality Berlin-Brandenburg e.V. platform establish contractual relationships solely between the user and the third party.

§ 2 Subject of Use, Access, and Operation

  1. The prerequisite for using https://extendedrealitybb.org is access to the internet. Internet connection may incur dial-up or phone charges depending on the user’s provider.
  2. Users can access information about Berlin, including topics in politics & administration, citizen services, the capital city, tourism & culture, and economic location, as well as general news through the portal. In addition, Extended Reality Berlin-Brandenburg e.V. offers various services, which are continuously updated. All new services that extend or improve the current scope of services are also subject to these Terms and Conditions.
  3. The use of services is free of charge unless specified otherwise for certain services. Extended Reality Berlin-Brandenburg e.V. expressly reserves the right to introduce fees for specific services.
  4. Users must register to use certain services. In such cases, the user is required to provide truthful, accurate, current, and complete personal information as specified in the registration form and update this data if necessary. Failure to do so may result in the user’s temporary or permanent exclusion from the use of services. Extended Reality Berlin-Brandenburg e.V. reserves the right to offer certain services only to users of legal age.
  5. Extended Reality Berlin-Brandenburg e.V. will provide an increasing number of e-government services, some of which may incur fees, for which additional Special Terms apply.
  6. Extended Reality Berlin-Brandenburg e.V. reserves the right to discontinue, modify, or otherwise change the website at any time. Due to technical reasons, there may be temporary and/or content restrictions in system availability. There is no entitlement to continuous access to the portal or uninterrupted availability of the services offered. This applies in particular when access to services is affected by disruptions beyond the control of Extended Reality Berlin-Brandenburg e.V.
  7. Extended Reality Berlin-Brandenburg e.V. strives to make the internet portal available to all users 24 hours a day, 7 days a week. However, temporary service interruptions due to regular maintenance, system-inherent disruptions of the internet with external providers, or higher force events may occur. Therefore, users have no claim to uninterrupted access to the portal.

§ 3 Responsibility for Content on https://extendedrealitybb.org

  1. Extended Reality Berlin-Brandenburg e.V. strives to provide accurate and complete information but does not guarantee the timeliness, accuracy, or completeness of the information on these pages.
  2. Extended Reality Berlin-Brandenburg e.V. grants the user a simple, non-transferable right to use its own content for personal use on a single system. Extended Reality Berlin-Brandenburg e.V. checks its content with standard programs for virus freedom.
  3. Regarding third-party content and information stored by Extended Reality Berlin-Brandenburg e.V. for a user, Extended Reality Berlin-Brandenburg e.V.’s responsibility is determined by § 11 TDG (German Teleservices Act). It is the user’s responsibility to verify the accuracy, legality, and virus freedom of third-party content and information.
  4. The portal user can access external websites via direct and indirect links that are not maintained or controlled by Extended Reality Berlin-Brandenburg e.V. Extended Reality Berlin-Brandenburg e.V. assumes no responsibility for the content of these external websites or third-party services. Extended Reality Berlin-Brandenburg e.V. cannot be held liable for damages or losses that arise from or in connection with the use of external content or reliance on such content, or due to goods or services obtained through such external sites or sources.
  5. Extended Reality Berlin-Brandenburg e.V. expressly declares that, at the time of linking, no illegal content was visible on the linked pages. Extended Reality Berlin-Brandenburg e.V. has no control over the current or future design of linked content and information.

§ 4 Links

Linking to the portal’s websites is generally permitted and free of charge. This also applies to links to the homepage of the city map (https://extendedrealitybb.org). A link to a subpage of the city map (an „individual city map link“ or so-called „deep link“) is only allowed with the explicit consent of Extended Reality Berlin-Brandenburg e.V. Extended Reality Berlin-Brandenburg e.V. reserves the right to allow such „individual city map links“ for commercial users in accordance with § 14 BGB only for a fee.

§ 5 User Obligations

  1. Activities by users aimed at making the services of Extended Reality Berlin-Brandenburg e.V. non-functional or at preventing, impeding, or delaying their use are prohibited and can be prosecuted by Extended Reality Berlin-Brandenburg e.V. under civil or criminal law. Users are specifically prohibited from installing files containing executable programs or scripts (e.g., cgi, perl, php formats), spreading or installing junk or spam emails, viruses, worms, or Trojan horses, engaging in email bombing or denial-of-service attacks, distributing copyrighted works (e.g., software, mp3 files, audio formats, image formats) without permission, or commercially exploiting products intended for private use (e.g., through banner advertising).
  2. Users must indemnify Extended Reality Berlin-Brandenburg e.V. from any third-party claims arising from or in connection with user activities as described in paragraph 1, to the extent the user is at fault. Extended Reality Berlin-Brandenburg e.V. has the right to exclude the user from using all services temporarily or permanently once it becomes aware of a violation of paragraph 1.

§ 6 Data Security

The internet is a public system. The disclosure of information by the user over the internet is at the user’s own risk. Data may be lost or fall into unauthorized hands. Nonetheless, Extended Reality Berlin-Brandenburg e.V. guarantees that within its systems, the program-related information provided will be protected according to usual standards and legal requirements.

§ 7 Data Privacy

The handling of personal data of users is governed by the Privacy Policy for the internet portal https://extendedrealitybb.org.

§ 8 Termination of the Contractual Relationship

The contract is generally concluded for an indefinite period unless otherwise specified in the Special Terms for a particular service. For services provided by Extended Reality Berlin-Brandenburg e.V. that do not require registration and are free of charge, both the user and Extended Reality Berlin-Brandenburg e.V. may discontinue the use or provision of services at any time.

§ 9 Liability of Extended Reality Berlin-Brandenburg e.V.

  1. Extended Reality Berlin-Brandenburg e.V. is liable under statutory provisions for damages resulting from injury to life, body, or health and for damages under the Product Liability Act.
  2. For other damages, Extended Reality Berlin-Brandenburg e.V. is liable only as follows: a) Extended Reality Berlin-Brandenburg e.V. is liable under statutory provisions for damages caused by malicious intent, willful misconduct, or gross negligence by Extended Reality Berlin-Brandenburg e.V., its legal representatives, or senior executives. b) Extended Reality Berlin-Brandenburg e.V. is liable for damages arising from minor negligence of essential contractual obligations or cardinal duties (first alternative), limited to the foreseeable damages typical for the contract. Extended Reality Berlin-Brandenburg e.V. is also liable for damages caused by simple vicarious agents of Extended Reality Berlin-Brandenburg e.V. through gross negligence or willful misconduct without breaching essential contractual obligations or cardinal duties (second alternative). c) In the case of § 9 para. 2 lit. b) first alternative, Extended Reality Berlin-Brandenburg e.V. is not liable for lost profits, indirect damages, consequential damages, or third-party claims.
  3. Extended Reality Berlin-Brandenburg e.V. is liable for data recovery only if the user has taken all necessary and reasonable data security precautions and ensured that the data can be reconstructed with acceptable effort from data material kept in machine-readable form.
  4. Any further liability of Extended Reality Berlin-Brandenburg e.V. is excluded. In particular, Extended Reality Berlin-Brandenburg e.V. is not liable for service failures or damages of any kind caused by denial-of-service attacks, email bombing, or computer viruses not attributable to Extended Reality Berlin-Brandenburg e.V.
  5. The user is obliged to report any damage as defined by the above liability provisions to Extended Reality Berlin-Brandenburg e.V. in writing or by email as soon as possible to allow Extended Reality Berlin-Brandenburg e.V. to act on damage mitigation or limitation measures together with the user. Regardless, the user is also obligated to undertake damage limitation measures.

§ 10 Copyright and Trademark Rights

  1. The website layout, graphics used, and texts—excluding official works of the State of Berlin available through the portal—are protected by copyright. Reproduction or use of such graphics and texts in other electronic or printed publications is not permitted without the express consent of § 10 Copyright and Trademark Law, apart from use for private purposes.
  2. § 10 Copyright and Trademark Law endeavors to respect copyright for all objects used in its publications, created by itself, or uses license-free graphics, sound documents, video sequences, and texts.
  3. All brands and trademarks mentioned on the website and protected by third parties are subject without limitation to the provisions of applicable trademark law and the rights of the respective registered owners.

§ 11 Miscellaneous

  1. Extended Reality Berlin-Brandenburg e.V. reserves the right to modify these Terms and Conditions at any time. If users do not object to the changes within four weeks, the amended Terms and Conditions are deemed accepted. If users object, the use of services under the previous Terms and Conditions can be terminated by either party.
  2. The General Terms and Conditions and any disputes arising from the use of the services are governed by the laws of Germany.
